General Terms and Conditions
§ 1 Scope
All orders shall be processed in accordance with the terms and conditions mentioned below. We oppose to incorporate any terms and conditions by the customer, unless otherwise explicitly agreed upon by the parties.
§ 2 Conclusion of Contract
(1) The range of products of the seller is solely a request addressed to the customer to submit a purchase offer. By placing an order, the customer submits a binding purchase offer to the seller. The seller shall accept the purchase offer by submitting a declaration of acceptance within 5 days after having received the purchase offer.
(2) The seller shall only enter into a contractual relationship with customers of full age. The customer undertakes to ensure that the delivery shall only be accepted by himself/herself or any other person of full age authorized by him/her.
§ 3 Prices
Prices stated by the seller are to be understood inclusive of the relevant German VAT and, if the goods are delivered on the customer’s request, and unless otherwise specified in the offer, plus postage and packing.
§ 4 Terms of Payment
Payments can be effected, credit solvency provided, after having received an invoice. The commercial invoice, issued by the seller, shall be sent out with the goods.
§ 5 Delivery/Minimum Number of Bottles for Deliveries
(1) Goods shall only be delivered within Germany and within 3-4 working days at the latest.
(2) The aforementioned period of delivery shall begin with the day following the day of the conclusion of contract. Should the last day of the delivery deadline fall on a Saturday, Sunday or Public Holiday at the place of delivery, the following work day shall replace this day.
(3) For wine orders on the customer’s request, the total number of bottles ordered must be divisible by 6. Exempted from this regulation are gift packages and sample boxes offered by the seller.
§ 6 Reservation of Title
The delivered goods shall remain property of the seller until all claims arising from contractual obligations are satisfied.
§ 7 Liability for Defects
Legal provisions shall apply. Shipping costs Germany: For wine/sparkling wine/Secco: Via DPD (6-60 bottles), very short delivery period of only 2 days guaranteed. Depending on total quantity of bottles, bottles will be packed in special boxes of 6 or 12. Deliveries carried out by a forwarding agent (from 66 bottles onwards) will be forwarded to you on a wooden pallet within 2-3 days. You have the option to select the preferred delivery day or give notice of a date by phone. To fix a preferred date, an additional charge of € 9 applies.
- up to 12 bottles: 8.40 EUR, VAT incl.
- up to 24 bottles: 9.90 EUR, VAT incl.
- from 36 bottles: free of shipping costs
For any other products, as far as not included: lump-sum: 6,90 EUR
Consumers are entitled to a right of revocation. In accordance with paragraph 13 BGB (German Civil Code), a consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession.
